Enclave Auth Supplemental License Terms

These Supplemental License Terms apply to use of @enclave-technologies/auth-react and @enclave-technologies/auth-sdk under an active Paid Plan subscription with Enclave Technologies Inc. They modify AGPL-3.0 obligations for incorporated use only while the subscription remains active.

These Supplemental License Terms ("Supplement") apply to a Customer's use of the `@enclave-technologies/auth-react` and `@enclave-technologies/auth-sdk` packages ("Licensed Software") ONLY for so long as the Customer maintains an active subscription to any plan other than Enclave's Free plan (each, a "Paid Plan") with Enclave Technologies Inc. ("Enclave"). The specific names, prices, and feature sets of Paid Plans may change from time to time at Enclave's discretion without affecting the terms of this Supplement.

DEFAULT LICENSE

The Licensed Software is made available to the public under the GNU Affero General Public License, version 3 ("AGPL-3.0"). Absent this Supplement, use of the Licensed Software is governed entirely by the AGPL-3.0, including its source-availability obligations for software made available over a network.

SUPPLEMENTAL GRANT

For as long as the Customer's Paid Plan subscription remains active and in good standing, Enclave grants the Customer a limited, non-exclusive, non-transferable license to use, reproduce, and distribute the Licensed Software as incorporated into the Customer's own application(s), WITHOUT the source-availability obligations imposed by Section 13 of the AGPL-3.0 (the "network use" provision) or any other AGPL-3.0 obligation that would otherwise require the Customer to make available the source code of the Customer's own combined or derivative work.

SCOPE

This Supplement applies only to the specific Application(s) registered under the Customer's Paid Plan account. It does not extend to:

  • any use of the Licensed Software outside of the Customer's registered Application(s);
  • any redistribution of the Licensed Software as a standalone product, competing authentication service, or software development kit offered to third parties;
  • any period during which the Customer's subscription has lapsed, been downgraded to the Free plan, or been terminated for any reason.

REVERSION ON LAPSE

If the Customer's Paid Plan subscription lapses or is downgraded to the Free plan, the Supplemental Grant in Section 2 terminates automatically and immediately. The Customer's continued use of the Licensed Software following such lapse is governed solely by the AGPL-3.0.

The Customer acknowledges that the Licensed Software verifies entitlement against Enclave's servers at runtime, rather than embedding a fixed, build-time determination of license status. As a result, termination of the Supplemental Grant under this Section takes practical effect automatically upon the Customer's application's next authentication event following any lapse, without requiring any code change, redeployment, or other action by the Customer. Enclave recommends the Customer keep the Licensed Software updated to a current version to ensure this runtime verification continues to function as described; this Section does not apply, and the Customer bears sole responsibility for compliance, with respect to any version of the Licensed Software modified to circumvent, disable, or predate this runtime verification behavior.

NO WARRANTY CHANGE

This Supplement modifies only the license terms described above. It does not create, expand, or modify any warranty, indemnity, service level, or support commitment — those are governed by the Customer's separate subscription/services agreement with Enclave, if any.

GOVERNING TERMS

In the event of any conflict between this Supplement and Enclave's general Terms of Service, this Supplement controls solely with respect to licensing of the Licensed Software; the general Terms of Service control all other matters.
